Terms of Service for Engineering Firms

Short summary

  • The engineering role opens after your documents are checked and approved.
  • You bid on EPC firms' engineering requests blind, without investor details; after selection, both parties' contact cards open.
  • Ufkon takes no commission and does not intermediate payments; professional responsibility lies with your firm.
  • In case of breach of the rules, bidding and unlocking may be restricted and your role may be suspended.

1. Parties and subject

These terms between Ufkon ("Ufkon") and the firm applying for the engineering firm role on Ufkon govern role approval, bidding on EPC firms' engineering requests, access to project requests that ask only for official process services, process tracking and the client record tool. The Terms of Use form part of these terms. If you buy credits to unlock, the Credit Sales Terms also apply, and for unlock disputes the Unlock Refund Policy.

These terms are general terms and conditions prepared in advance by Ufkon for use with many firms. Provisions that may operate against your firm are written in bold; on application you confirm with a separate box that you have read and accept them. An engineering firm is a business acting for commercial or professional purposes; consumer law does not apply to this relationship.

2. Application and role approval

  • You upload the documents requested in the application (e.g. tax certificate, engineering or chamber registration certificate, where required trade registry record and references; for firms established abroad, a registration document) accurately, up to date and belonging to your firm.
  • Ufkon reviews the documents as of the time of the check and approves the application, asks for missing documents or rejects it with reasons. Approval does not mean that Ufkon guarantees your firm's professional competence.
  • In your profile you state the provinces you serve; if you do not, you receive notifications for all provinces. A person or firm linked to an account on the investor side cannot hold the engineering role.

3. Engineering requests of EPC firms

  • An EPC firm that has unlocked a project request may open an engineering request for that project (e.g. call letter, connection agreement, project drawing, project approval, acceptance). The request contains only blind fields such as province, installed capacity, requested items and bid deadline; the investor's name, contact details and address are not shown to you.
  • Your firm may submit one bid per request and may update or withdraw it within the deadline. The bid amount is for information; you may not share contact details in the bid note.
  • Before selection the EPC sees bids under aliases such as "Firm A" and "Firm B". After selection, each party sees the other firm's card (display name, authorised person, verified e-mail) and the work is tracked through process steps and a document vault.
  • A firm holding an unlock in the main project request, and its related firms, cannot bid on that project's engineering request; a firm that bid on the engineering request, and its related firms, cannot unlock the main project request. Firms related to the requesting EPC through the same umbrella account, group of companies, tax number or a personal link do not see the request.

4. Project requests asking only for official processes

  • An investor may ask in a project request only for official process services (permit, application and approval procedures). These requests are notified to you when published in your service province.
  • Unlocking these requests is done, where an announced price applies, for the credit price shown at the time of unlock; if no price has been announced, this option is not offered. When you unlock, you gain access to the investor's contact details and may submit a bid. An unlock does not guarantee winning the job or that the investor will respond.
  • In a dispute about an engineering unlock, only the reasons wrong number, duplicate request and the investor having agreed the job with another firm may be used; filing deadlines and the evidence procedure are as in the Unlock Refund Policy. The reason "client unreachable" cannot be used for this seat.
  • For the investor data in a request you unlock, your firm is a separate data controller; you use this data only for that project and may not sell it, transfer it to third parties or add it to unrelated marketing lists. In your first contact with the investor you state your firm's trade name and that you reached their details through Ufkon.
  • If the investor wishes, they may open a process line to follow the stages of the work; you may leave the line at any time, and a neutral notification is sent to the investor.

5. Free use, commission and professional responsibility

  • Bidding on EPC engineering requests is free of charge today. If a fee is introduced, the price is announced before it applies and your separate acceptance is requested.
  • Ufkon takes no commission, does not intermediate payments and performs no payment, refund or scoring operation tied to process steps. Contract, invoice, payment and delivery are between the commissioning firm and you.
  • The professional and legal responsibility for the engineering service you provide lies with your firm; Ufkon is not responsible for the accuracy of projects, calculations, applications and documents or their compliance with the law and professional rules.

6. Client record tool (mini CRM)

  • In the client record tool in your dashboard you may record your own clients' names, telephone numbers, e-mail addresses and notes, and your tasks. Your firm is the data controller for these records; informing your clients and, where required, obtaining their consent is your responsibility.
  • Ufkon stores these records encrypted, only to provide the tool to you, on your behalf and on your instructions (data processor); it does not use them for other purposes and does not show them to other users. You may delete a record at any time.

7. Rules of conduct

  • You submit bids that are realistic, that you can perform and that are within your competence. False or misleading bids, sharing contact details to lead the other party off the platform, persistent or disrespectful communication and sharing other people's personal data are prohibited.
  • Documents you upload to process steps go through a security scan; files containing malware are removed.

8. Personal data and retention

  • How Ufkon processes your data and your employees' data is explained in the privacy notice for firms.
  • For completed engineering jobs, bid notes, process notes and process documents are deleted 24 months after closing; job, bid and step records are kept.

9. Suspension and termination

  • In case of untrue or expired documents, use of investor data for other purposes, breach of the rules of conduct, repeated unjustified disputes, circumvention of the related firm rule or any other material breach of these terms, Ufkon may restrict your right to bid and unlock, suspend your engineering role or terminate the agreement.
  • Except where delay would be harmful, the decision is notified in advance with reasons by e-mail or KEP and you are given at least 5 business days to explain. You may object to the decision; the objection is reviewed by an authorised person other than the one who made the decision.
  • You may end the agreement at any time by closing your role or account. The fate of unused credits is subject to the Credit Sales Terms. Your data obligations under section 4 continue after termination.

10. Liability

  • Ufkon does not guarantee that you will receive requests, that your bid will be selected or that the service will run without interruption.
  • Ufkon's total liability under these terms is limited to the total amount your firm paid Ufkon in the 12 months before the damage arose; indirect damage and loss of profit are excluded. This limit does not apply to intent or gross negligence of Ufkon.
  • Your firm is responsible for third-party claims arising from the service it provides, its bids, its use of investor and client data and breach of these terms.

11. Changes, notices and disputes

  • Material changes to your detriment are not applied unilaterally; the new version is shown in the dashboard and your approval is requested. If you do not accept, you may end the agreement.
  • Notices are sent to your firm's registered e-mail or KEP address; notices to Ufkon are sent to destek@ufkon.com (KEP: none).
  • These terms are governed by the laws of the Republic of Turkiye. The Istanbul (Caglayan) Courts and Enforcement Offices have jurisdiction over disputes; if your firm is not a merchant, the general rules of jurisdiction apply.
