Right of Withdrawal Exception Notice (Listing Fee)

Short summary

You have no right of withdrawal for a project request you paid a listing fee for: the service is performed instantly in electronic form and, with your approval, before the withdrawal period ends.
This approval is taken on the payment screen with a separate box that is not pre-ticked; without it no payment can be made.

This notice is for individual (consumer) investors paying a listing fee. Corporate buyers acting for commercial or professional purposes are not consumers; the right of withdrawal regime does not apply to them.

In distance service contracts a consumer normally has a 14-day right of withdrawal starting on the day the contract is concluded.
The listing fee is the fee for publishing your project request in the Ufkon blind pool. The service is performed instantly in electronic form after payment approval; where a short pre-publication check is needed, its performance starts immediately, before the withdrawal period ends and with your approval.
Therefore, under the Distance Contracts Regulation Art. 15/1 (services performed instantly in electronic form, and services whose performance started with the consumer's approval before the withdrawal period ends), the right of withdrawal cannot be used.

By ticking the separate box on the payment screen you declare that you want performance of the service to start immediately, before the withdrawal period ends, and that you learned before paying that you therefore have no right of withdrawal.
The box is not pre-ticked. If you do not tick it, payment cannot start and no contract is concluded; no fee is charged.
Your approval is stored with the text version, date and technical record.

Even without a right of withdrawal, the fee is refunded in full if: you withdraw the project request before it goes live; it is rejected in the pre-publication check; it cannot be published for a reason on the side of Ufkon; the payment arrives after the payment deadline; or the fee is collected twice.
