1. Parties
- Service provider: Ufkon (brand: Ufkon) · Tax identification number: — · Tax office: — · Address: (postal address will be added before paid sales start; written requests: info@ufkon.com) · Phone: [operator details to be added] · E-mail: destek@ufkon.com · KEP: none · Website: ufkon.com
- Buyer: the investor account making the payment (individual or corporate); identity and billing details are as registered in the account.
2. Subject and scope
- The subject of this agreement is publishing the buyer's project request in the Ufkon blind pool in return for the listing fee shown on the payment screen. The listing fee is paid to open a new project request while the free concurrent allowance is full or to renew an expired project request. Project requests kept open within the free concurrent allowance are free; if no firm unlocked an expired project request, the first renewal is free.
- The service is putting the request live and, for the listing period, keeping it open for unlocking by installer firms with verified documents while the buyer's identity stays hidden. There is no cap on the number of firms that may unlock; each firm (firms in the same group together) unlocks the request once. Messaging on the platform with firms that unlocked, and optional preliminary bids, are part of the service.
- Ufkon does not install systems, takes no commission, and is neither a party to nor a guarantor of any contract between the buyer and firms; the agreement is concluded outside the platform. Ufkon does not promise that any firm will unlock, that any bid will be received or that any agreement will be reached.
3. Price, payment and invoice
- The price is the amount shown on the payment screen including all taxes; the amount excluding VAT and the VAT are shown separately on screen and on the invoice. Ufkon charges nothing beyond this amount.
- Payment is made by card with 3D Secure on the secure page of the contracted bank or payment institution, or by bank transfer (EFT). The card number does not reach Ufkon servers.
- If the fee is not paid by the payment deadline shown on the payment screen, the project request is cancelled; no fee is charged.
- An e-archive invoice is issued after payment, sent to the buyer's e-mail address and kept in the panel.
4. Conclusion of the agreement
- On the payment screen the buyer ticks the box confirming that they have read the Pre-Contract Information Form and accepting this agreement; an individual buyer also ticks the right of withdrawal exception box. The boxes are not pre-ticked.
- The agreement is concluded by the buyer's approval that creates the obligation to pay (moving to the payment page for card payments, or confirming the bank transfer option). The order is shown on the transaction screen without delay; receipt of payment is also notified by e-mail.
5. Performance
- After payment is confirmed, the project request goes live immediately or passes a short pre-publication check, carried out to prevent fake and duplicate requests, and is published as soon as the check ends. During the check firms cannot see the request.
- The listing period and unlock rules are those in force at publication and are shown in the request file. These rules are not changed against the buyer during the listing.
- If performance becomes impossible, Ufkon notifies the buyer within 3 days of learning of it and refunds the fee under section 6.
6. Refunds
- The fee is refunded in full in these cases: withdrawal before going live; rejection in the pre-publication check; failure to publish for a reason on the side of Ufkon; a payment arriving after the payment deadline; the same fee collected twice.
- Once the project request is live, the service is deemed performed and the fee is not refunded. Withdrawing a live request, no firm unlocking, no bids arriving or no agreement between the parties are not grounds for a refund.
- Refunds are made within 14 days at the latest from the date the refund ground arises, to the means of payment used, free of charge and in one go.
7. Right of withdrawal (consumers only)
- The right of withdrawal cannot be used for this service: the service is performed instantly in electronic form (Distance Contracts Regulation Art. 15/1, sub-paragraph on instant electronic services) and, where a pre-publication check is needed, its performance starts with the consumer's approval before the withdrawal period ends (Art. 15/1, sub-paragraph h). The consumer approves this exception before payment with a separate box (Right of Withdrawal Exception Notice).
- A corporate buyer is not a consumer; the right of withdrawal regime does not apply.
8. Obligations of the parties
- The buyer knows that the information in the project request must be accurate and that their contact details are shared with unlocking firms only for this project. Fictitious, fake or third-party requests are not published.
- For requests that breach the Terms of Use, the provisions of the Terms of Use apply.
- Ufkon is responsible for providing the service with due care and for not showing the buyer's identity to firms before unlocking.
9. Liability
- Ufkon is not responsible for the services or bids offered by firms or for the performance of contracts concluded between the parties. This limitation does not cover intent, gross negligence or the consumer's statutory rights.
10. Records, delivery and changes
- This agreement and the Pre-Contract Information Form are recorded with the approved version and date; a link to the approved versions is sent by e-mail after payment. The texts can be viewed, printed and saved on this page.
- A payment already made is governed by the version approved at the time of payment. Later changes apply only to new payments.
11. Disputes
- Complaints can be sent to destek@ufkon.com or made by phone at [operator details to be added].
- A consumer buyer may, within the legal monetary limits, apply to the consumer arbitration committee at their place of residence or where the transaction was made; for disputes above those limits, to the consumer court after first applying to a mediator, as required by Law No. 6502 Art. 73/A.
- Disputes with corporate buyers are governed by Turkish law; statutory mandatory mediation rules are reserved.
